Under the North Carolina Unfair and Deceptive Trade Practices Act, policyholders may be entitled to “treble damages,” three times the amount of any damages caused by the insurer's unfair or deceptive actions. Alternatively, even if these statutory violations may not exist in your case, certain conduct can still give rise to common law bad faith that can allow the recovery of punitive damages from the insurance company. In those situations, we will tenaciously pursue such claims.
